Terms and Conditions of Business and Use

If you want to buy wine or products from us or use our web site you can only do so on these terms and conditions, and by registering/ purchasing on the web site you are agreeing to be bound by them. We may change these from time to time by updating this posting.

  1. Delivery
    1.  Delivery is £5.99 per delivery regardless of how many cases you order. So grab the bargains quick. (Wine and Spirits only/ If you order any other product that we sell delivery charges will vary) We will deliver your products to anywhere in the United Kingdom (excluding Northern Ireland, the Highlands, Scottish islands, the Isle of Man and the Scilly Isles, to which further charges  apply)

We normally deliver Monday to Friday. You may give us instructions to leave the product with someone. This person must be over 18 years of age and be able to prove it with a valid passport/ driver license

If you prefer to have the product delivered to you in person, we will of course do so. If you are not there the driver will leave a card for you to arrange a more convenient delivery time.

    1. Breakages
      1.   In the event that any of the bottles in your case are damaged, please let us know within 24 hours and we will issue you a full refund for those bottles. Upon return of the damaged products.

    1. Availability – If there is a delay in getting the product to you, you will be informed.  
    2. Customer satisfaction - If you are dissatisfied with our performance in any way, please contact our team immediately on 01704-568159. At Empire Booze, we aim to deal with all enquiries fairly, confidentially and quickly. We try to resolve most issues immediately, but where this is not possible; we will keep you informed about progress until a satisfactory resolution has been achieved. We are continually improving our service, but if you have any particular ideas or suggestions about how we can improve, please send them to sales@empirebooze.co.uk.
  1. Prices and payment
    1. All prices are quoted in pounds sterling, and may be per bottle or per case, as marked. The prices include Value Added Tax, unless otherwise specified. Any delivery charges are additional.
    2. We accept payment by Visa, Visa Electron, Maestro, American Express, Diners Club, JCB, Laser, Solo, and ELV.
    3. Any discounts offered are based on buying in quantity. The more you buy the more you can save.
    4. We reserve the right to terminate any special offer at any time, without notice.
  2. Age restriction
    1. We won't sell wine to anyone who isn't 18 years old or over. Sorry, but that's the law. By placing an order you confirm that you are at least 18 years old.
    2. If you are buying a case of wine as a gift - the recipient must also be over 18 years old.
    3. If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the wine is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the wine.
    4. Sorry to have to state the obvious, but once the wine has been delivered, according to your original delivery instructions; it becomes the recipient's responsibility.  
  3. Cancellations
    1. You may cancel your order for any reason whatsoever at any time up to 24 hours from the day after the date you receive your wine, provided all of the bottles are unopened and intact.
    2. In order to cancel your order you must call us on 01704-568159, notify us by email on sales@empirebooze.co.uk or in writing to Empire Booze Ltd 278 Liverpool Road, Birkdale, Southport, PR8 4PE
    3. We shall reimburse the price of the wine within 30 days from the date you notify us of the cancellation. It is your responsibility to hold onto the wine and take reasonable care of it until we come to collect it.
    4. You the customer will be responsible for the cost of all transport cost to you and its return.
  4. Returns
    1. If some or all of the bottles of wine in a case are broken or spoiled when they are delivered you should notify us as soon as possible. You must return just the affected bottles for a refund.
    2. You must notify us of all wines which are due to be returned for any of the reasons stated in this clause within 24 hours, From delivery You can call us on 01704-568159, notify us by email on returns@empiebooze.co.uk
    3. All refunds and reimbursements due will be paid within 30 days of you notifying us of your wish to return products, provided the product has been collected by our carrier.
    4. Any product collected by our carrier must be in their original box to avoid further breakages, where possible.
    5. Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misdescribed goods. Further information about your rights is available from your Local Authority Trading Standards Department or Citizen's Advice Bureau.
  5. Intellectual Property Rights  
    1. You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.
    2. All persons, individual and corporate, are prohibited from providing hypertext or other links to the empirebooze web site, other than to our home page, from their own web site or from a third party's web site, without our prior written consent.
  6. Warranties
    1. We warrant that the wines will be of satisfactory quality and fit for their general purpose.

 

  1. Limitation of liability
    1. Nothing in these Terms and Conditions shall exclude Empire Booze Internet Ltd liability for personal injury or death caused by its negligence.
    2. We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:
      1. loss or damage was not foreseeable to both parties when the contract was formed;
      2. loss or damage was not caused by any breach on the part of the supplier;
      3. Loss or damage relates to business and/or non-consumers.
    3.  We will not be liable for loss or damage caused by the customer handling the wine. In particular we will not be liable for spillages or breakages.
    4. Customers should also be aware of the following inherent risks and warnings:
      1. Alcohol should be consumed in moderation.
      2. A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
      3. Red wine in particular may cause staining if spilt so extra care should be taken.
      4. Sparkling wines and champagnes can be volatile due to the build up of gasses extra care should be taken when opening these.
  2. Data Protection
    1. By providing your details to Empire Booze on our web site, you consent to Empire Booze maintaining, recording, holding and using the information you give Empire Booze at the time of ordering to process your orders, to improve our service to you and inform you of promotions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.
    2. Empire Booze Privacy Promise. We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your product to you, e.g. our delivery company. From time to time, Empire Booze Internet Ltd may send information about discounts, free stuff and personalised offers on products, unless you have told us not to do so by emailing us at sales@empirebooze.co.uk
    3. If you opt-out from hearing from Empire Booze or third parties, you will only be contacted by Empire Booze if our terms and conditions change.

 

                      General

    1. We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.
    2. Empire Booze may change or add to these terms and conditions for security, legal or regulatory reasons. We will not use this right to vary the terms of any special offer that applies to you.
    3. The sale of the goods takes place only when the product is ordered and dispatched. Until that time, no charge will be made to your credit card and Virgin Wines will not be bound to supply the goods at the price.
    4. Relevant United Kingdom law will apply to these terms and conditions and the relevant courts of the United Kingdom will have exclusive jurisdiction.

 

  1. Corporate Orders
    1. Corporate Definition
      a corporate order is an order where the corporate customer orders 10 or more cases on the same order.
    2. Delivery Address(es)
      Where an order(s) contain(s) goods to be delivered to more than one delivery address, it is the responsibility of the corporate customer placing the order(s) to ensure that all delivery address(es) provided to Empire Booze are correct. If goods are delivered to an incorrect address (es) as a result of incorrect information provided by the corporate customer, Empire Booze will not take responsibility for this and the corporate customer will be charged for the cost of replacement goods and the cost of delivering the replacement goods to the correct address (es).
    3. Payment
      We accept payment from corporate customers by Visa electron, Visa, Maestro, American Express, Diners Club, JCB, Laser, Solo, ELV, MasterCard,  bank transfer and cheque. In the case of payment by bank transfer and cheque the order(s) will only be shipped when cleared funds have been received in Empire Booze bank account.  

 

 Alcohol should be consumed in moderation.

      1. A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
      2. Red wine in particular may cause staining if spilt so extra care should be taken.
      3. Sparkling wines and champagnes can be volatile due to the build up of gasses within the bottle so extra care should be taken when opening and handling these.
